Welcome to TopWorkPh, a platform that connects clients with skilled freelancers (referred to as “TopWorkers”). By accessing or using our platform, you agree to comply with and be bound by the following Terms and Conditions (“Terms”). If you do not agree to these Terms, please refrain from using our services.

1. Definitions
Client: Any individual or entity using the TopWorkPh platform to find and hire freelancers (TopWorkers).
TopWorkers: Freelancers registered on the platform providing services to Clients.
Platform: The TopWorkPh website, tools, and services offered to both Clients and TopWorkers.
Project: Any service or task that a Client hires a TopWorker to complete through the platform.
2. Eligibility
Clients must be at least 18 years of age and have the legal capacity to enter into contracts. By using TopWorkPh, you represent and warrant that you meet these eligibility criteria.

3. Use of the Platform
Clients may use the platform solely for the purpose of identifying, contacting, and hiring TopWorkers. Any use of the platform for other purposes, including but not limited to unsolicited advertising, is prohibited.

4. Payments
4.1. Payment Processing
TopWorkPh facilitates payment processing between clients and TopWorkers for services rendered. By using our platform, you agree that all payments will be processed by TopWorkPh.

4.2. Payment Methods
TopWorkPh supports various payment methods Gcash, PayMaya or electronic fund transfers. By using these payment methods, you authorize TopWorkPh to charge the agreed-upon amount to the selected payment method when payments are due.

5. Relationship between Clients and TopWorkers

TopWorkPh acts as an intermediary platform to facilitate connections between Clients and TopWorkers. TopWorkPh does not employ TopWorkers nor is responsible for the performance of their services. The contract is directly between the Client and the TopWorker.

6. Client Responsibilities

– Provide clear and accurate project details.
– Respond promptly to communications from TopWorkers.
– Make timely payments for completed work.
– Adhere to all applicable laws and regulations in the course of using the platform.

7. Intellectual Property

Any intellectual property rights related to work created by TopWorkers as part of a project belong to the Client, subject to any agreements or terms established between the Client and the TopWorker.

8. Dispute Resolution

In the event of a dispute between a Client and a TopWorker, TopWorkPh may offer mediation services. However, TopWorkPh is not responsible for resolving disputes, and Clients and TopWorkers are encouraged to resolve issues independently or through legal means if necessary.

10. Limitation of Liability

TopWorkPh is not liable for any direct, indirect, incidental, or consequential damages arising out of the use of the platform, including but not limited to, the performance of TopWorkers or any disputes between Clients and TopWorkers.

11. Indemnification

Clients agree to indemnify, defend, and hold harmless TopWorkPh, its officers, directors, employees, and agents from any and all claims, liabilities, damages, and expenses (including legal fees) arising out of your use of the platform, violation of these Terms, or violation of any rights of a third party.
